Asbestos Visual Clearance Inspection and Certificate requirements

As per WHS General Regulations r. 466

Regulator must be notified of asbestos removal

A licensed asbestos assessor must give written notice to the regulator at least 5 days before the removalist commences licensed asbestos removal work.

Penalty for this subregulation:

(a)  for an individual, a fine of $4 200;

(b)  for a body corporate, a fine of $21 000.

Among other information required, a licensed asbestos removalist must notify the regulator in writing at least five days before the licensed asbestos removal work commences and list the name of the licensed asbestos assessor or independent competent person engaged to carry out a clearance inspection and to issue a clearance certificate for the work

A clearance inspection under WHS regulation 473 — a person who has acquired through training or experience the knowledge and skills of relevant asbestos removal industry practice and holds —

(i)  a certification in relation to the specified VET course for asbestos assessor work; or

(ii)  a tertiary qualification in occupational health and safety, occupational hygiene, science, building, construction or environmental health;
